Vancouver-based liquefied natural gas (LNG) developer Steelhead LNG has initiated legal proceedings against Cedar LNG, Pembina Pipeline Corporation, and ARC Resources Ltd. in British Columbia. The lawsuit relates to the Cedar LNG Project, with Steelhead alleging that the defendants improperly utilized confidential information provided by Steelhead to ARC Resources. This information, according to Steelhead, was used to facilitate the development of LNG facilities in British Columbia, benefitting Cedar LNG.
In its legal claim, Steelhead LNG seeks several remedies, including halting ARC Resources' involvement in the Cedar LNG Project, securing damages for the unauthorized use of its proprietary information, and obtaining an injunction to prevent further misuse. The company asserts that without ARC Resources' commitment—allegedly acquired through wrongful means—Cedar LNG and Pembina Pipeline would have been unable to secure the significant financial backing required for the project's final investment decision.
Victor Ojeda, President of Steelhead LNG, expressed disappointment over the lack of resolution through dialogue. "It is evident to Steelhead that, without relying on ARC Resources' capacity commitment—enabled by what Steelhead believes to be a pattern of willful and wrongful conduct—Cedar LNG and Pembina would not have been able to secure the substantial financial commitments necessary to reach a positive final investment decision," he stated. "While Steelhead remains open to pursuing an amicable resolution, ARC, Pembina, and Cedar have shown little interest in doing so. As a result, Steelhead has no choice but to seek judicial intervention."
Additionally, Marty Proctor, a former CEO of Seven Generations Energy and a current director of ARC Resources, has been named as a defendant in the lawsuit.
Steelhead LNG emphasizes its portfolio of patents, which encompass LNG export facility solutions in Canada, the United States, Korea, Australia, and Mexico. The company recently announced the issuance of three new U.S. patents, expanding protections for its innovative near-shore LNG facility designs.
Meanwhile, Steelhead LNG continues to pursue separate legal action in Korea against Cedar LNG and Samsung Heavy Industries. This ongoing litigation addresses alleged infringement of Steelhead's Korean patent related to its LNG technologies.
This lawsuit underscores Steelhead LNG’s commitment to protecting its intellectual property and proprietary innovations in the competitive LNG industry. The company has emphasized its willingness to resolve disputes amicably but remains firm in seeking legal recourse to address what it views as significant breaches of trust and misuse of its information.
Steelhead LNG is a prominent developer in the LNG sector, committed to promoting sustainable energy solutions through cutting-edge technology and strategic collaborations. The company prioritizes efficiency and environmental responsibility throughout the LNG value chain.
