Australia Concludes Investigation, Finding No Anti-dumping Duty Imposed on Ammonium Nitrate Imports from Vietnam

In a momentous turn of events, the Australian Anti-Dumping Commission (ADC) has arrived at a momentous verdict concerning its anti-dumping investigation pertaining to the imposition of anti-dumping duties on ammonium nitrate products originating from Vietnam and Lithuania. This definitive conclusion was officially announced on August 8, 2023, effectively absolving Vietnamese enterprises from the imposition of anti-dumping duties on their ammonium nitrate products.

The inception of the investigation, which focuses on ammonium nitrate products entering the Australian market, dates back to June 8, 2022. This comprehensive inquiry encompassed three nations: Chile, Lithuania, and Vietnam.

Of the five principal ammonium nitrate exporting countries to Australia, Vietnam, Chile, and Lithuania were singled out for allegations of engaging in practices of dumping ammonium nitrate products. However, in August 2022, the ADC terminated the investigation with regard to Chile, citing the absence of any exports of ammonium nitrate products from the country during the specified investigative timeframe.

Moving forward, a significant juncture was reached on May 30, 2023, when the Australian Anti-Dumping Commission released its preliminary determination for the anti-dumping investigation focused on ammonium nitrate products originating from Lithuania and Vietnam. This preliminary finding underscored that Vietnam bore no responsibility for causing damage or posing threats to Australia's domestic production sector or its market. Consequently, the verdict declared that no anti-dumping duties would be levied on ammonium nitrate products originating from Vietnam.

Crucially, the investigation process was marked by extensive cooperation from Vietnamese enterprises actively involved in the production and export of the products under scrutiny. These enterprises diligently furnished the essential data and information required by the Australian Anti-Dumping Commission throughout the duration of the investigation.

The robust and transparent nature of this collaboration, in tandem with the prompt and the comprehensive responses to inquiries from the investigative agency, significantly contributed to the attainment of a favorable outcome for the case. As meticulously assessed by the Vietnam Trade Remedies Administration, the investigative procedures executed by Australia adhered to the principles of objectivity, transparency, and meticulous consideration of the data and information provided by Vietnam.

The culmination of these efforts has yielded a positive verdict for Vietnamese enterprises, setting the stage for a conducive environment that facilitates the continued export of goods to the Australian market.
